Beta-Testing Agreement


Definitions

This beta-testing agreement sets the terms and conditions of your participation in a beta-testing campaign run by a publicly-funded research project or any other type of organisation from the ReachOut website and platform.

  • ReachOut ReachOut is a H2020 project aimed at helping research project reach out to their potzential market by helping them set up beta-testing campaigns by means of a methodology and the ReachOut website and platform.
  • Beta-testing campaign A Beta-testing campaign is a time-bound operation in which software developers from publicly-funded research project or any other type of organisation solicit third party users to execute a tutorial on the software with the aim to receive feddback.
  • Participating project A participating project is an ad-hoc organisation aimed at undertaking research and software development in the framework of a publicly-funded research project or any other type of organisation.
  • Beta-testers Beta-testers are developers, IT professionals and End-users who voluntarily test the beta version of a software and report feedback. Beta Testers do not belong to team who develops the software.
  • Beta version A beta version of a software is a version of a software designed to be handed over to beta-testers who will report feedback. The beta version is not the final, nor commercial version of a software.

Eligibility and Enrollment

To be eligible to participate in a beta testing campaign, you must have read and agreed to the informed consent verification and the rules of contest.

Copyright, Ownership and Acceptable Use

Unless stated differently Copyright, Ownership and Acceptable Use of all software made available to beta-testers through the ReachOut website and platform are regulated by the terms of the open source licence attached to it. Unless stated differently Copyright, Ownership and Acceptable Use of all content made available to beta-testers through the ReachOut website and platform are regulated by the terms of the creative commons licence attached to it.

Disclaimer of Liability and Warranty

You are offered to use a beta version of the Participating project software which is still undergoing final development and testing before its official release. The Participating project software, website or content are provided on an “as is” and “as available” basis. PROJECT does not give any warranties, whether express or implied, as to the suitability or usability of the Participating project software, website or any of its content. The Participating project will not be liable for any loss, whether such loss is direct, indirect, special or consequential, suffered by any party as a result of their use of the Participating project software, website or content.

Data Protection and Privacy

The Privacy of bata-testers is guaranteed in compliance with the European General Data Protection Regulation (GDPR) which came into force on the 25th of May 2018 and as implemented by the OW2 the main hosting organisation of the project and described in the Data Protection page.

Modification

This agreement constitutes the entire agreement between you, the bate-tester, and the participating project relating to the subject matter hereof and all other terms are rejected. No waiver or modification of this Agreement shall be valid unless in writing signed by each party. The waiver of a breach of any term hereof shall in no way be construed as a waiver of any term or other breach hereof. If any provision of this Agreement is held by a court of competent jurisdiction to be contrary to law the remaining provisions of this Agreement shall remain in full force and effect.

Applicable Law

This Agreement shall be construed in accordance with and governed by the laws of Belgium excluding its conflict of law provisions.
